Agreement and operator

These Terms govern your use of ElderDecks, operated by McKee Realty NYC Inc., based in New York, NY, United States ("ElderDecks," "we," "us"). By creating an account or otherwise accepting these Terms, you agree to them. If you do not agree, do not create an account or use features requiring agreement. Our Privacy Policy explains data handling; accepting these Terms does not itself give consent to optional advertising or tracking.

Questions, reports, and legal requests can be sent to elderdeckssuport@gmail.com. These Terms do not remove any consumer or other rights that cannot legally be waived.

Eligibility and account security

You must be at least 13 and meet any higher minimum age required by applicable law. If you are below the age of legal majority, use the service only with the permission and supervision of a parent or legal guardian who can accept these Terms where required. Do not misrepresent your identity or create accounts for someone without authorization.

Provide a valid email address and accurate required account information, complete required verification, and keep your credentials secure. You are responsible for activity you authorize and for promptly notifying us of suspected compromise. Do not share passwords, sell accounts, or circumvent account restrictions. We may take reasonable steps to verify access and protect the service.

What the service provides

ElderDecks provides card and deck tools, collection tracking, articles, and manual or simulated playtesting. Features, integrations, and availability may change. Unless separately and expressly agreed, the service carries no uptime, data-backup, tournament-accuracy, or compatibility guarantee. Keep independent exports of records important to you.

Prices, availability, printings, legality, categories, salt scores, recommendations, and simulated outcomes can be incomplete, delayed, or incorrect. Verify material details with the retailer, official game rules, or tournament organizer before relying on them. A collection value is an estimate, not a guaranteed sale value or financial advice. Scanner matches require your review.

AI-assisted output and abstract simulations are not official rules engines or guaranteed strategic advice. You remain responsible for decisions, cards played, and purchases. Do not rely on the service for legal, financial, or other professional advice.

Your content and permissions

You retain the rights you hold in your original submissions. You must have the rights and permissions needed to upload or share text, images, decks, and other material, including personal information about others. Third-party card artwork and game materials remain subject to their owners' rights.

You grant us a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, transmit, and display your submissions only as reasonably necessary to operate, secure, and provide the service and the sharing features you choose. We may allow service providers to do this on our behalf. This is not a transfer of ownership or a general license to sell your private content.

Publishing or sharing content authorizes its display to the audience selected. Public material may be indexed, copied, exported, or linked by others; unlisted links can be forwarded. Deleting content or ending an account ends this operational license except as needed for lawful retention, backups, resolving disputes, and copies others independently obtained through permitted sharing. We cannot recall third-party copies.

Community submissions reflect their authors' views. We do not endorse every deck description, comment, article submission, or linked resource, and we do not promise to review everything before publication.

Acceptable use

  • Do not violate law, infringe intellectual property, impersonate others, defraud users, or publish information you have no right to disclose.
  • Do not harass, threaten, exploit, or target people with hateful abuse, disclose another person's private information, or distribute unlawful sexual or exploitative content.
  • Do not upload malware, compromise accounts, bypass access controls or rate limits, disrupt games or servers, or use automation that materially burdens or damages the service.
  • Do not manipulate views, likes, advertisements, commissions, or other metrics; generate invalid ad traffic; or encourage fraudulent ad clicks.
  • Do not use the service for spam, unauthorized advertising, unlawful sales, or deceptive claims of affiliation. Follow applicable third-party terms for linked or integrated services.
  • Do not probe other users' private data. Report security issues privately to elderdeckssuport@gmail.com without exploiting them or publicly disclosing personal data.

Multiplayer and communications

You control whether to join a room, share a link, enable your microphone, or reveal game information. Other participants can see shared board state and hear enabled voice chat. Room hosts may manage participation; we do not guarantee another player's behavior, identity, availability, or compliance with game rules.

Do not record or redistribute another person's communications without any permission required by law. We do not provide a voice-recording feature, but cannot control recordings made by participants. Rooms and sessions are temporary; save anything you need outside the game.

Retailers, ads, and affiliates

Retailer prices and links are informational. ElderDecks is not the seller of cards purchased through external links and does not guarantee stock, condition, edition, shipping, authenticity, returns, taxes, or the final checkout price. The retailer's terms govern the transaction. Selecting missing cards or preparing a cart does not purchase them; review the retailer's checkout yourself.

We may earn commissions from qualifying affiliate purchases and receive advertising revenue. Paid relationships do not make a retailer or advertiser our agent, and an ad is not a guarantee or endorsement. Third-party sites, tracking, and services have their own terms and privacy practices.

These Terms do not authorize undisclosed fees. Any future paid ElderDecks feature must disclose its price and applicable billing, cancellation, and refund terms before you agree to pay.

ElderDecks and game intellectual property

Except for your submissions and third-party materials, ElderDecks branding, software, and original site content belong to us or our licensors. We grant you a limited, nonexclusive, revocable permission to use the service for its intended purposes while complying with these Terms. This does not grant ownership of our software or a right to misrepresent our endorsement.

Magic: The Gathering and related game names, artwork, symbols, and materials belong to Wizards of the Coast LLC, Hasbro, Inc., and their respective owners. ElderDecks is an unofficial fan site and is not affiliated with, sponsored by, or endorsed by those companies. Catalog providers and retailers retain their own rights. Attribution is not a transfer of rights or permission for unrestricted reuse.

Reports and copyright concerns

Report unlawful, infringing, or abusive content to elderdeckssuport@gmail.com. Include the exact URL, the content at issue, the reason for your report, and enough contact information for a response. For copyright concerns, identify the protected work, the allegedly infringing material, and your authority to act; include a good-faith statement that the use is unauthorized, an accuracy statement under penalty of perjury where applicable, and your physical or electronic signature.

We may request clarification, restrict access, remove material, notify the submitting user, and address repeated infringement or other serious violations. Reports must be truthful. Contact us to dispute a moderation decision or explain a claimed authorization. This contact address is not a representation that we have registered a designated DMCA agent or qualify for any particular statutory safe harbor.

Suspension and ending your account

You may stop using ElderDecks at any time and request account deletion using the contact in our Privacy Policy. We may restrict content, suspend access, or end accounts for material violations, legal requirements, security risks, abuse, or discontinuation of the service. Where practical and lawful, we will give notice and an opportunity to address the issue; urgent risks may require action without prior notice.

Termination does not erase lawful retention obligations or third-party copies. Provisions that by their nature should continue, including intellectual-property protections, accrued obligations, liability limits, and dispute provisions, survive termination to the extent permitted by law.

Disclaimers and limits of liability

To the maximum extent permitted by applicable law, the service is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, accuracy, availability, or noninfringement. We do not warrant that every error will be corrected or that access will be uninterrupted or completely secure.

To that same extent, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, opportunities, or data arising from use of the service. Our total aggregate liability for claims arising from the service is limited to the greater of US $100 or the amount you paid us for the service in the 12 months before the event giving rise to the claim.

These exclusions do not limit liability that cannot lawfully be excluded, including applicable liability for fraud, willful misconduct, gross negligence, or death/personal injury caused by negligence, or mandatory consumer remedies. Some jurisdictions do not allow certain exclusions or caps; in those cases they apply only to the lawful extent. Nothing here excludes our obligations under applicable data-protection law.

Responsibility for unlawful use

To the extent permitted by law, you are responsible for third-party claims and reasonable resulting costs caused by your unlawful submissions, infringement of others' rights, or intentional misuse of the service. This does not require you to cover losses caused by our own unlawful conduct, or remove protections applicable to consumers or minors. We will provide reasonable notice of a claim and will not agree to a settlement imposing obligations on you without your consent.

Governing law and disputes

New York law governs these Terms, excluding its conflict-of-laws rules, except where mandatory law requires otherwise. Subject to nonwaivable rights and jurisdictional requirements, disputes may be brought in the state or federal courts located in New York County, New York. If local consumer law permits you to bring a claim in your home courts or gives you additional protections, these Terms do not take those rights away.

Please contact elderdeckssuport@gmail.com to try to resolve concerns informally. Doing so is not a requirement that prevents an urgent legal remedy or a legally protected complaint. These Terms do not impose mandatory arbitration or a class-action waiver.

Changes and general provisions

We may revise these Terms prospectively. We will update the date and provide notice of material changes appropriate to the circumstances; additional acceptance will be requested where required. Changes do not retroactively remove accrued rights. If you do not agree to revised terms, stop using the affected features and contact us about your account.

If a provision is unenforceable, the remaining provisions continue to the extent lawful. A delay in enforcing a right is not a waiver. You may not transfer your account or obligations without permission; any transfer of our service or agreement remains subject to applicable law and your nonwaivable rights.
